Transferring Temporary Staff under the new State Contract

Contingent Workforce - c100 State Contract

The new Temporary Staff (Contingent Workforce - c100) contract is now live.
The new contract has a 3 month Transition Period for transferring temporary staff from outgoing to incoming suppliers. The transition period is from the 20th April 2009 to the 19th July 2009. Temporary staff currently engaged in a NSW government agency with an outgoing supplier of the new contract, will need to be transitioned to an incoming supplier of the new contract.

Supplier Responsibilities
NSW Procurement looks forward to the cooperation of all incoming and outgoing suppliers of the new contract, and expects transition activities to be in line with the Industry Codes of Conduct for transitioning.

NSW Government expects that;

  • Incoming suppliers will make a written request to an outgoing supplier, following contact by the relevant NSW Government Agency, for the transition of temporary staff;
  • Outgoing suppliers will notify temporary staff that a Transition Request has been received from an incoming supplier, and properly inform the temporary staff of matters relevant to his/her decision to transition;
  • Outgoing and incoming suppliers will negotiate the transition of the temporary staff, in line with the Industry Codes of Conduct for transitioning;
  • The outgoing supplier will inform the temporary staff of matters relevant to his/her decision to transition;
  • Incoming suppliers will immediately apply the new contract pricing once a Temporary Staff personnel has been transitioned;
  • Outgoing and incoming suppliers conduct transition activities in accordance with their Industry Codes, i.e. without penalty to temporary staff, NSW Government Agencies or suppliers;
  • Incoming suppliers only provide temporary staff for the categories to which they have been awarded.
NSW Government Responsibilities
NSW government agencies have been;
  • Informed that they must tell outgoing suppliers that a transition is required, in addition to contacting incoming suppliers regarding transition;
  • Informed of the 3-month Transition Period and the supplier responsibilities relevant to transition;
  • Provided with a Transitioning Kit to assist with the effective and efficient transition of temporary staff;
  • Encouraged to prepare for transition by identifying all temporary staff, the suppliers they are currently with and contacting incoming suppliers to arrange transitions.
